ADD OR AMEND A PENSION REVERSION NOMINATION FOR AN INCOME STREAM

There are two ways in which you can add or amend a pension reversion nomination for an income stream:

• the first is to commute the income stream (if permissible) then to recommence the pension with a reversionary nominated – see Pension Reset;
• the second is to amend the terms of an existing pension to either add or remove a pension reversion nomination in relation to that income stream.

IF YOU HAVE AN EXISTING TOPDOCS PENSION AGREEMENT YOU SAVE

To utilise our Pension Reversion Nomination documentation you are not required to have a Topdocs pension agreement in place for the pension. However, if the pension agreement currently in place for the pension was prepared by Topdocs, you will only be charged $275 (inc GST) for your documentation.

REQUIREMENTS TO AMEND THE PENSION REVERSION NOMINATION

To utilise our Pension Reversion Nomination documentation, the Fund must be on either the Topdocs SMSF Governing Rules version 14.01, 15.01 or 16.02. This is due to the trust deed for the Fund needing to contain specific provisions to enable the member to amend the reversion nomination if the amendment is made during the term of the income stream.

In addition, if the income stream has a pension agreement in place, that is not a Topdocs pension, this will need to be provided at the time of ordering your documents as our lawyers will review this agreement during the process of preparing the amendment documentation.

Please note that if the pension does not have a pension agreement in place, you can still utilise our Pension Reversion Nomination documentation.

Every Pension Reversion Nomination package comes with an individual letter of legal sign off, noting that a lawyer has reviewed the documents and confirmed the new nomination is valid and effective.
