Trusts can have a life of up to 80 years in most States or Territories and, over time, changes in legislation, case law and general industry strategic changes can greatly impact the effectiveness of trust deeds.

Amongst other things, this can lead to:

unnecessary payment of tax or duty surcharges;
issues of control on the death of the trustees or appointors; and
an inability to maximise the tax effectiveness of the trust as an investment vehicle.

In this practical webinar, we will explore the key provisions your client’s discretionary trust deeds should contain to maximise the effectiveness of their trust, including:

the role of trustee, including appointment, cessation, removal, incapacity and survivorship
the role of appointor, including appointment, cessation, removal, incapacity and survivorship
avoiding unnecessary tax and stamp duty surcharges – focusing on the NSW land tax surcharge, as well as the relevant state-based stamp duty surcharges now applicable in VIC, NSW, TAS, WA, SA and QLD where the trust is deemed a ‘foreign trust’. Discussion will include how these surcharges can be avoided through appropriate amendments or restructuring
vesting provisions and ensuring your client doesn’t get caught out
